Terms of Service

Welcome to Focused Manifesting ("the Platform," "the Service," or "we/us/our"). These Terms of Service ("Terms") constitute a legally binding agreement between you and Focused Portal governing your access to and use of our website, applications, and services. By creating an account, subscribing, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Service.

1. Acceptance of Terms

By accessing, browsing, or using Focused Manifesting, whether or not you create an account, you agree to these Terms in their entirety. We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a prominent notice on the Service. Your continued use after such notice constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and may cancel your account.

2. Description of Service

Focused Manifesting is a manifesting and personal growth platform providing:

• Structured courses and educational content
• Manifesting tools (Manifesting Formula, Dream Board, Dream Plan, Feel Good List, I Am List, Release Valve, Thank You, Cancel Cancel, Strengths & Weaknesses, and related tools)
• Sapphire AI assistant for guidance and support
• Community features and engagement
• Media library (Neural Reprogrammer) with audio, video, and PDF content
• Video-based course content
• Other manifesting and personal development resources

The Service may be modified, suspended, or discontinued in whole or in part at any time. We do not guarantee availability of any specific feature or content.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. The Service is not intended for minors.

4. Account Registration and Security

Certain features require an account. You agree to: (a) provide accurate, current, and complete information during registration; (b) maintain and promptly update your information; (c) keep your password confidential and secure; (d) accept full responsibility for all activities occurring under your account; and (e) notify us immediately of any unauthorized use. We are not liable for any loss or damage arising from your failure to protect your credentials.

5. Subscription, Payment, and Billing

• Subscription Tiers: Subscription plans, pricing, and features are displayed at the time of purchase and may be updated from time to time.
• Payment Processing: Payments are processed securely through Stripe or other payment processors we designate. We do not store full payment card details; such data is held by our payment processors and governed by their respective policies.
• Free Trials: If a free trial is offered, you will be charged when the trial ends unless you cancel before that date.
• Recurring Charges: By subscribing, you authorize us to charge your payment method on a recurring basis (e.g., monthly or annually) until you cancel.
• Currency and Taxes: All fees are quoted and charged in U.S. Dollars (USD) unless otherwise stated. You are responsible for any applicable taxes.
• Refunds: Fees are generally non-refundable except as stated in Section 5.1 (Refunds and Cancellation) below.

5.1 Refunds and Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at support@focusedmanifesting.com. Cancellation takes effect at the end of your current billing period; you retain access until then. We do not offer prorated refunds for partial periods. If you cancel during a free trial, you will not be charged. Due to the digital nature of our content, we generally do not offer refunds for subscription fees already paid. Refund requests may be considered case-by-case for technical issues, duplicate charges, or exceptional circumstances—contact support@focusedmanifesting.com. If you dispute a charge with your bank (chargeback) without contacting us first, we may suspend or terminate your account. We may change prices from time to time; we will notify you in advance and give you the option to cancel before the new price takes effect.

6. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any applicable laws, regulations, or third-party rights
• Harass, abuse, defame, threaten, or harm any person
• Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
• Upload, post, or transmit content that infringes intellectual property, privacy, or other rights of others
• Use automated systems (including bots, scrapers, or scripts) to access or interact with the Service without our prior written consent
• Interfere with, disrupt, or overwhelm the Service or its infrastructure
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Circumvent any access controls, security measures, or usage limits

We reserve the right to suspend or terminate your account immediately, without prior notice, for any violation of these Terms or for any other reason at our sole discretion.

7. Intellectual Property

All content on the Platform—including but not limited to text, graphics, logos, images, audio, video, course materials, and software—is owned by Focused Portal or our licensors and is protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, modify, create derivative works, publicly display, or exploit any such content without our prior written permission.

You retain ownership of content you create (e.g., Dream Board images, Dream Plan entries, notes). By posting or storing such content through the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to store, display, process, and transmit that content solely to provide, operate, and improve the Service.

8. Disclaimer—Content and AI

The content, tools, and features on Focused Manifesting—including courses, manifesting techniques, Sapphire AI assistance, Dream Plans, affirmations, and related content—are provided for personal growth, inspiration, and entertainment only. Nothing constitutes medical, psychological, psychiatric, legal, financial, tax, or other professional advice. Always seek qualified professionals for such matters. We do not guarantee any specific outcomes from manifesting, visualization, affirmations, or other techniques. Our Sapphire AI assistant and AI image generation are powered by third-party systems; outputs may be inaccurate, incomplete, or inappropriate. Do not rely on AI content for health, financial, legal, or safety decisions. You use the Service at your own risk and are solely responsible for your decisions and actions.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION OF THE SERVICE. WE DO NOT GUARANTEE ANY SPECIFIC RESULTS FROM MANIFESTING, COACHING, OR OTHER TECHNIQUES OFFERED ON THE PLATFORM.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOCUSED PORTAL, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless Focused Portal and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms or any applicable law; (c) your violation of third-party rights; or (d) any content you submit through the Service.

12. Termination

You may cancel your account at any time through your account settings or by contacting us at support@focusedmanifesting.com. We may suspend or terminate your access, with or without notice, for violation of these Terms, fraud, abuse, or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (including Sections 7, 9, 10, and 11) will survive termination.

13. Governing Law and Disputes

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts of competent jurisdiction. You consent to the personal jurisdiction of such courts.

14. General

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Focused Portal regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right does not waive that right.
